Terms & Conditions

ORDER INFORMATION

We DO NOT ship to APO, FPO, HOTELS, & P.O. BOXES.

You may request a cancellation of your order, provided that your order has not already been processed & shipped. To do so, you must send an email to sales@newcaretherapies.com or fax a written request to (502) 647-1951. Without written consent, your order will not be voided.

Unless stated otherwise on the invoice, stated prices do not include any customs, duties, sales, use, value added, excise, federal, state, local or other taxes. You shall pay for all such duties or taxes.

A few orders may take extra days to process and ship, due to the low stock quantity at the time of processing. You will be contacted if a delay occurs.

You are encouraged to read our Terms & Conditions before you place your orders. Order Placement constitutes that you understand and accept the terms and condition stated herewith.

We reserve the right to cancel any credit card approved and authorized orders due to the following reasons:

The orders paid by credit cards not issued by U.S. banks or other domestic financial institutions.

Either the shipping or billing address of the orders is located out of the United States.

The message generated by the credit card processing company shows that the verification of the credit card is incomplete.

PAYMENT INFORMATION

We accept Visa and Mastercard for all credit card orders. We do not accept orders paid by credit cards originally issued by any financial institution outside of the United States.

We do accept Cashier Checks, Money Orders, and Wire Transfers. However, we will only ship the products out after these payments have been cleared. You can call us at 800-432-6249 for further details.

We do not accept COD.

Orders of less than $5,000.00 require a minimum 25% Deposit payable upon placement of order. Orders greater than $5,000.00 are subject to a minimum 50% Deposit payable upon placement of order. All orders must be paid in full prior to shipment unless special arrangements have been made. Billing Terms are "Due Upon Receipt".

SHIPPING INFORMATION

All shipping dates are approximate and are based upon current availability of products and prompt receipt of all necessary information. All orders may take 1-2 business days to process. Pickup day does not count as a shipping day. The customer will be contacted through email and/or telephone for backorder items. Backorder items will be shipped out as soon as the product is available.

Shipping is direct cost provided to us by various carriers. We add no other fees of any kind to freight. We attempt to procure the lowest possible freight cost on every order.

All deliveries are insured and guaranteed against loss, theft and damage. However, we will not be personally liable for any damage, loss, fault or expenses arising out of delays in shipment or other non-performance of this Agreement caused by or imposed by:

Strikes, fires, disasters, riots, Acts of God;

Acts of customer;

Governmental action; or

Any other cause or condition beyond newcaretherapies.com’s reasonable control in the event of any such delay or non-performance

We will not be responsible for the delay in delivery by delivery service. In the event of a delay, the Customer Service Department will track the order. The accuracy of the address is the responsibility of the cardholder. We reserve the right to cancel any approved orders that have different billing information and shipping information.

Address corrections that are made while in transit or after delivery to a wrong address are expense to the cardholder credit card as we incur charges for this service.

Refused or undeliverable shipments will be subject to a 25% restocking fee, in addition to applicable shipping fees, insurance fees, and any losses incurred by us.

All orders are F.O.B. (Freight On Board) origin unless otherwise agreed to in writing.

You are responsible for all other fees and / or charges inclusive but not limited to reroute fees, any customs, duties, sales, use, value added, excise, federal, state, local or other taxes, unless stated otherwise on the invoice.

CUSTOM ORDERS

Some items found on this website are custom built per order. Cancellations of these product orders will not be accepted unless they are cancelled within 3-days of order placement. Returns will not be accepted. Order changes will be considered depending upon the nature of the change and the stage in manufacturing that your order is in. Changes may be subject to fees depending upon materials wasted (if any) during manufacturing.

The following products are considered custom orders: All Furniture Products (Excluding Folding Chairs and the 7000 series), All customized wheelchairs, Model 4795 Bariatric HI/Lo Examination Tables, All Products utilizing special order fabrics, Custom sizes outside standard dimensions, Bariatric Power Chairs and Scooters.

RETURN MERCHANDISE AUTHORIZATION (RMA)

Newcaretherapies.com offers our customers a 30-day replacement on all defective items. For all other products, please contact manufacturer for return or exchange after 30 days.

All DOA (Dead On Arrival) products must be reported to New Care no later than 3 business days after you receive the product.

All claims for shortage, manufacturers' defects, shipment error, incompatibility, or incorrectly ordered merchandise must be made within 3 business days from the delivery date.

We reserve the option to accept or reject non-defective returns. Merchandise must be packed securely and be returned to Newcaretherapies.com undamaged, and must include original packaging, manuals, warranty cards, documentation, and all other accessories. You will be solely responsible for paying all return freight costs and insurance either defective or non-defective merchandise. It is recommended that all returns be made via a traceable carrier such as FedEx, UPS or Certified Mail as Newcaretherapies.com is not responsible for items that are misdirected or lost in shipment.

Merchandise is subject to testing before replacement will be issued. Newcaretherapies.com sends defective merchandise to the manufacturer, which takes about 15 to 30 days in most cases to process. As soon as we receive the repaired product, we will ship it out. We reserve the right to return to you any non-defective merchandise or any merchandise that does not match the invoice. You will be responsible for all related charges such as shipping, insurance, testing, and handling fee on this matter.

We reserve the option to require that defective merchandise returns be accompanied by a test report from an independent laboratory in order to receive a refund, credit, or replacement on merchandise.

All credits will be issued within 15 business days once we confirm that this is the only solution to solve your return.

All non-defective merchandise returns are subject to twenty percent (25%) restocking fee or current market value at Newcaretherapies.com's discretion. All non-product related fees such as shipping, transaction, payment processing, and insurance are not refundable. Our liability shall be limited to the invoiced value of the merchandise or its replacement.

PRODUCT WARRANTY INFORMATION

Merchandise must be returned in original condition including packaging, documentation, warranty cards, manuals, and accessories. Aside from New Care's return policy, all warranty work should be performed through the manufacturer of your product.

No warranty by Newcaretherapies.com shall apply to any merchandise, which have been modified or damaged by the customer. Merchandise that is defective due to misuse, neglect, or improper installation is not covered under the warranty. We are not responsible for any damages incurred to customer's equipment or data resulting from an improper installation.

All warranties begin from the date of invoice.

No employee, agent, or dealer of Newcaretherapies.com is authorized to make any modification, extension, or addition to this warranty.

LIMITATION ON LIABILITIES

Product descriptions posted on our product pages are generated from the manufacturers or our suppliers. Please note that actual products may differ slightly from picture. We are not responsible for typographical, pricing, product information, advertising or shipping errors. Advertised prices and available quantities are subject to change without notice.

In no event shall we be responsible for incidental or consequential damages, including loss of use, income or profits, arising out of or in connection with this agreement including, without limitation, breach of any obligation imposed on us hereunder or in connection herewith, even if we have been advised of the possibility of such damages.

In no event shall we be liable for any expenses incurred by the customer for any installation done by someone other than us.

In no event shall Newcaretherapies.com have liability (whether under the theories of breach of contract or warranty, negligence or strict liability) in excess of the purchased price paid for the goods.

TRADEMARKS

All other company, product or service names referenced in this Web site are used for identification purposes only and may be trademarks of their respective owners.

Newcaretherapies.com reserves the right to cancel an order for merchandise that has been advertised in error, is unexpectedly out of stock, does not conform to specifications, or shipped in error.
